文化创新主旨下我国文化立法的价值维度及现实向度

摘　　要：文化创新是文化的生命,是实现文化赓续发展,彰显文化之价值与功能的根本要求。正因如此,我国现行宪法明确规定了公民以创作创造为核心的文化权利。然而,当前我国传统文化行业在现代信息科技环境下所遭遇的窘迫情势、整体文化行业遭遇的“软收缩”态势、文化体制改革陷入的进展缓慢困局、文化自信面临的相对不足窘境,都在深层次上暴露了我国文化创新的乏力。当下,应当把握我国文化立法窗口期,在既有文化法及即将出台的《文化产业促进法》的基础上,进一步以推动文化创新为主旨,加强文化立法、健全文化法律体系,为我国文化创新发展提供坚实的法律支撑和保障。为此,有必要研究推动以“文化创新基本法”为核心的我国文化法律体系之建立,并在此基础上推动文化创意和文化产权法律保障制度、文化开放与文化融合法律促进制度、文化治理法律保障制度等文化创新基本制度建设。Cultural innovation is the life of culture,and it is the fundamental requirement to realize the continuous development of culture and to highlight the value and function of culture.For this reason,the Constitution of our country clearly stipulates the cultural rights of citizens with creation as the core.However,the embarrassment that China s traditional cultural industry is currently faced with in the modern information technology environment,the“soft contraction”situation encountered by the overall cultural industry,the slow progress of cultural system reform,and the relative lack of by cultural self-confidence all deeply exposed the weakness of China s cultural innovation.At present,we should grasp the window period of our country s cultural legislation,on the basis of the existing cultural law and the upcoming“Cultural Industry Promotion Law”,further take promoting cultural innovation as the main theme,strengthen cultural legislation,build cultural legal system,and provide solid legal support and guarantee for the development of our country s cultural innovation.Therefore,it is necessary to study and promote the establishment of the cultural legal system with the“basic law of cultural innovation”as the core,and on this basis,establish a cultural innovation system which includes several key institutional systems such as the legal system for cultural creativity and cultural property rights,the promotion system for cultural opening and integration laws,and the legal protection system for cultural innovation governance.
