犯罪的一般理论之实证检验--以集资诈骗犯罪为视角

摘　　要：犯罪的一般理论作为犯罪学中检验自我控制能力与犯罪性关系的理论,经常用于检验青少年犯罪,却很少用于检验经济犯罪。就集资诈骗犯罪成因而言,亟需依靠理论分析其内在逻辑关系,从而有助于从犯罪人层面预防犯罪。研究表明,犯罪的一般理论内涵及应用范围需做进一步界定。犯罪的一般理论认为犯罪性与犯罪人的自我控制能力有关,自我控制能力越低的人越容易犯罪。通过对集资诈骗罪判决书实证研究发现该结论并不成立,甚至得出自我控制能力与犯罪性呈现正向相关关系的结论。本文研究认为,集资诈骗犯罪中“潜在犯罪人”群体年龄偏大,且无法通过提高受教育程度来达到控制犯罪的目的。因此,犯罪的一般理论并不适用于集资诈骗犯罪。The general theory of crime,as the theory of testing the relationship between self-control ability and criminality,is often used to test juvenile crime,but it is rarely used to test economic crime.However,the connotation of the theory and previous studies indicate that the scope of application of the theory should be further framed.For the current research on the causes of fund-raising fraud crime,it is also urgent to rely on theory to facilitate analysis,which will help prevent crime from the aspect of the criminal.The general theory of crime believes that criminality is related to the criminal’s self-control ability:the lower the self-control ability,the easier for committing a crime.Through empirical research on the judgment of the crime of fund-raising fraud,it is found that this conclusion is not true;instead,there is positive correlation between self-control ability and criminality.Therefore,according to this study,the“potential criminals”of fund-raising fraud crimes are older and cannot achieve the purpose of controlling crime by increasing their education level;meanwhile,the general theory of crime does not apply to fund-raising fraud crimes.
