村规民约的社会基础及其运作机理——以鲁中D村为例

摘　　要：村规民约作为农村社会长期存在的一种地方性规范,它立足于村庄社会,在村庄秩序维系和社会教化等方面发挥着十分重要的作用,但对村规民约发挥效力的村庄基础及其相应的作用机理却鲜有研究。通过对鲁中农村的个案研究发现,现代村规民约能够发挥效力是建立在利益关联的村集体经济和民主有为的村庄政治等村庄基础之上。在此前提下,村规民约通过利益重合下的价值引导机制、组织配套下的监督保障机制和福利关联下的惩罚机制得以有效运行,从而在村庄治理和社会教化等方面发挥积极作用。As a long-standing folk law in rural society,the village regulations are based on the village society and play a very important role in the maintenance of village order and social education.However,the village foundation and corresponding mechanism of action for the effectiveness of the modern village regulations have rarely been studied.Through the study of a village in Shandong province,the paper found that the modern village regulations can be effective on the basis of the collective economy and active village politics.Under this premise,the village regulations can be effectively operated through the value guidance mechanism under the overlapping interests、the supervision and guarantee mechanism under the organization and the punishment mechanism of welfare association,it plays an important role in village governance and social education.
