摘　　要：对监狱行刑各项制度的实施效果进行实证分析,可以为完善监狱法律制度提供实践依据。围绕监狱改造、分类管理与考核、减刑、假释、暂予监外执行等若干重要监狱行刑制度的实施效果的问卷调查表明,法官、检察官、监狱人民警察、律师等法治工作者、社会公众以及服刑罪犯等不同群体的评价存在一定程度上的共识,即都相对消极。不同群体在心理矫治的效果、减刑假释暂予监外执行的适用数量、以及监狱执法行为的合法性等问题上,存在较大的认知分歧。改革与完善监狱行刑制度,需要加快《监狱法》全面修订的进程,并着力解决部门规章碎片化问题。An empirical analysis of the implementation effect of various systems of prison execution can provide a practical basis for improving the prison legal system.The questionnaire survey on the implementation effect of a few important prison execution systems,such as prison re-education,classified management and assessment,commutation,parole,temporary execution outside prison,shows that such legal workers as judges,prosecutors,prison people’s police and lawyers,the public and criminals in prison have a consensus to a certain extent,that is,they are all relatively negative.There are great cognitive differences among different groups on the effect of psychological correction,the number of commutation and parole temporarily implemented outside prison,and the legality of prison law enforcement behavior.To reform and improve the prison execution system,we need to speed up the process of comprehensive revision of the Prison Law and strive to solve the problem of fragmentation of departmental regulations.
