摘　　要：石油天然气管道安全保护带制度是《石油天然气管道法》的核心部分,但理论界和实务界对该管道安全保护带的主要性质、划定依据、权利结构等的认识并不统一。石油天然气管道安全保护带是以"不得危害和危及管道安全"为原则,以管道本体为中心,按照对管道安全构成危险的危险源性质和距离管道中心线宽度不等的危险等级划分的连续禁限作业地带,包括管道安全核心保护带、管道安全重点保护带、管道安全高危风险控制带。在石油天然气管道的禁限作业等级地带,因危险源的性质、等级不同而成立不同的法律关系,共同构成石油天然气管道安全核心保护带、管道安全重点保护带法律制度。The system of safety belt of oil and gas pipeline is the core of Law of Oil&Gas Pipeline Protection,but disagreements exist about the nature and rights structure,and the criteria for designation of the safety belt in both the theoretical and industrial circles.The safety belt of oil and gas pipeline,which consists of the core protection belt and the key protection belt and the high-risk protection belt,is a continuous operation restriction zone graded according to risk level of hazard sources nature and the different distances from pipeline center line based on the principle of“no harming and endangering the pipeline safety”,focusing on the safety of pipeline itself.In the operation restriction zones of oil and gas pipelines,different legal relationships are established due to the different nature and grade of hazard sources,which together constitute the legal system of oil and gas pipeline safety core protection zone and pipeline safety key protection zone.
