摘　　要：对商业秘密立法现状进行梳理研究,论证我国商业秘密专门立法的必要性及可行性。在知识产权强国背景下,商业秘密的法理价值应系统发掘,即其属性为信息领域的无形财产权、权利边界中公共领域具有他限性、主体客体具有特殊性及排他效力具有相对性,并提出了商业秘密专门立法的整体构想。This paper firstly sorts out the research status of trade secret legislation in existing literature and demonstrates the necessity and feasibility of making special legislation for trade secret protection in China.On the basis of elaborating on its legal value as an important content of intellectual property,this puts forward some systematic suggestions on special legislation of trade secrets.
