人类命运共同体下网络空间法治体系与中国方案

摘　　要：在人类命运共同体和网络科技发展的大数据时代,网络空间安全与治理问题成为全球治理对象之一。营造和平、安全、开放与合作的网络空间,构建全球网络空间法治体系,是国际社会共商共治共享的必然选择。在当今的数字经济时代,网络霸权主义现象、通过计算机进行网络犯罪、散布破坏性病毒、泄露隐私数据以及垃圾软件泛滥等网络空间安全问题,严重阻碍了全球经济发展。目前,国际社会尚未构建系统的互联网空间法治体系、治理的主体存在争议以及数字鸿沟现象等难题,均是全球网络空间治理体系的障碍。为此,构建网络空间命运共同体,需要国际社会大环境与时俱进的配合、治理层内部明确治理的目标和对象、坚持一定的空间治理原则以及在大国博弈中及时调整治理策略。同时,中国正处于由网络大国向网络强国转型的关键期,抓住独有的数字机遇、化挑战为督促力量,可为全球网络空间治理贡献有中国印记的中国智慧。In the era of big data entailed by the development of network technology and the background of a community of shared future for mankind, cyberspace security and governance issues have become one of the targets of global governance. Creating a peaceful, secure, open and cooperative cyberspace and building a global cyberspace governance system under the rule of law are inevitable choices for the international community to discuss, govern and share. Today, in the era of digital economy,such issues on cyberspace security as cyber hegemony, cybercrimes, the spread of destructive viruses, the leakage of private data, and the proliferation of junk software have severely hindered global economic development. At present, difficulties like the lack of a systematic legal governance system for the cyberspace by the international community, disputes on governance subjects and digital divide are obstacles for the global cyberspace governance system. Therefore, building a community with a shared future in cyberspace requires the coordination of the international community’s progress with the times, clear goals and objects within the governance layer, adherence to certain governance principles, and timely adjustment of governance strategies in the game of great powers. At the same time, China is in a critical period of transforming from a cyber power to a major cyber power.It should seize unique digital opportunities, turn challenges into drives, and contribute Chinese wisdom to the global cyberspace governance under rule of law.
