重大疫情应对中的公民法治思维培养

摘　　要：目前,我国在新型冠状病毒肺炎疫情防控中取得巨大成效。为进一步增强我国在社会重大公共卫生事件应对中的现代化治理能力,培养公民的法治思维,以法治精神去思考和处理疫情中出现的利益冲突至关重要。疫情中公民法治思维的培养能促使其自觉维护社会公共安全,控制疫情蔓延;严格规范行为边界,保障疫情中的社会管理秩序;科学分析社会现象,避免疫情中的社会恐慌。目前,针对部分公民法治思维出现的偏差,如对法律权利与法律义务的割裂、对法律权威地位的忽视、对法律法规的情绪化解释等问题,应注重培养公民以下几点意识:兼顾公益优先与尊重个人权利,全面认知作为义务与不作为义务,采用科学严谨的法律方法鼓励公民进行公共参与。At present,the novel coronavirus pneumonia epidemic prevention and control in China has achieved positive results.In order to enhance the ability of modern governance in response to major public health events and cultivate citizens'legal thinking,it is very important to think about and deal with the conflicts of interest in epidemic situation in the spirit of law.By the cultivation of legal thinking,citizens will consciously maintain social public security and control the spread of the epidemic.They will strictly regulate their behavior boundary and ensure the social management order in the epidemic.They will scientifically analyze social phenomena and avoid social panic in the epidemic.At present,in view of the deviation of some citizens'legal thinking,such as the separation of legal rights and obligations,the neglect of legal authority,and the emotional interpretation of law and regulations,we should pay attention to the cultivation of the following awareness of citizens:taking into consideration both the priority of public welfare and respect for individual rights,cognizing action and inaction comprehensively,and adopting scientific and rigorous legal ways to encourage citizens to participate in public affairs.
