摘 要:新就业形态自兴起之时就对现行劳动法律提出了严峻的挑战。国际上在应对这些挑战的过程中逐渐形成了司法手段、工会创新、行业自治等主要改革路径。这些改革目前仍然无法彻底解决新就业形态从业者权益保障不足的困局。因此,各国开始转而跳出目前的劳动立法体系,并尝试从打破劳动关系认定与权益保障的捆绑关系和扩大社保覆盖范围两个角度进行立法重构。我国目前的劳动立法改革与国际潮流具有高度的相似性,未来可从明确平台从业者基本权益保障、扩大社会保障尤其是工伤保险的覆盖范围、严厉打击虚假自雇三个方面进行改革。Since the new forms of employment emerged,the current labor law has been facing severe challenges.Although the international community has used some major reform approaches in the process of dealing with this challenge,such as judicial means,the trade union reform,and profession autonomy etc.,these reforms cannot completely address issues on the inadequate protection of the rights and interests of workers in the new forms of employment.Therefore,various countries began to go beyond their current labor legislation system,and reconstruct new labor legislation through the following two approaches:breaking the link between labor relations and their corresponding basic rights protection and extending the coverage of the social security.China has a high degree of similarity in the adjustments of labor law compared with international practices,and can improve the labor law system in the following aspects:safeguarding the basic rights and interests of the platform workers,enlarging the coverage of current social security system,especially in work-related injury insurance,and crack down on the bogus self-employment.
