公立医疗卫生机构监察对象范围探析

摘　　要：《中华人民共和国监察法》明确其立法目的是对所有行使公权力的公职人员进行监察。然而,理论界对公立医疗卫生机构监察对象的范围一直存在争议。从监察对象的界定争议入手,通过对公权力、公职人员等核心概念内涵加以分析,提出公立医疗卫生机构监察对象的界定标准;结合公立医疗卫生机构的性质和人员组成等实际情况,进一步分析公立医疗卫生机构监察对象的范围,为公立医疗卫生机构监察对象的准确认定提供参考。The supervision law of the people's Republic of China clearly states that its legislative purpose is to supervise all public officials who exercise public power.However,the scope of public health supervision has been controversial.Starting from the dispute on the definition of supervision object,the author puts forward the definition standard of supervision object of public medical and health unit through the analysis of the concept connotation of public power and public servant,and further analyzes the scope of supervision object of public medical and health unit combined with the actual situation of the nature and personnel composition of public medical and health unit.In order to provide a useful reference for the accurate identification of monitoring objects in public medical and health units.
