优化营商环境背景下的项目代办制研究——基于区域实践与法治保障的视角

摘　　要：投资项目全程代办制是在优化营商制度环境背景下地方政府进行的自主性制度建构,该制度推行的主要目的在于通过政府无偿为企业和项目提供代办服务,破解投资项目审批程序复杂、耗时长的难题。该制度目前已经形成了以江苏为代表的作为“不见面审批”的补充措施,以浙江为代表的作为“最多跑一次”改革的制度支撑,以及以四川为代表的“三特别”模式。该制度的推行能够推动政府职能转变,提高政府服务意识,优化营商环境,提高区域核心竞争力,强化制度构建的规范性,推动地方法治发展。项目代办制正在逐渐向规范化、法治化、标准化发展,但是仍需要进一步拓展该制度的适用范围和明确全程代办过程中委托代理关系的法律性质,同时还要加强权力监督,防止代办过程中的变相权力寻租,为全程代办制的进一步推广提供法治保障。The whole process agency system of investment projects is an independent system construction carried out by local governments under the background of optimizing the business system environment.The main purpose of the system is to provide agency services for enterprises and projects by the government free of charge,so as to solve the problem of complicated and time-consuming investment project approval procedures.At present,the system has formed a supplementary measure of"not meeting examination and approval"represented by Jiangsu Province,the system support of"running once at most"represented by Zhejiang Province,and the"three special"mode represented by Sichuan Province.The implementation of the system can promote the transformation of government functions,improve government service awareness,optimize business environment,improve regional core competitiveness,strengthen the standardization of system construction,and promote the development of local rule of law.The project agency system is gradually developing towards standardization,legalization and standardization.However,it is still necessary to further expand the scope of application of the system and clarify the legal nature of the principal-agent relationship in the whole process of agency.At the same time,it is necessary to strengthen the power supervision to prevent the disguised power rent-seeking in the process of agency,so as to provide legal guarantee for the further promotion of the whole process agency system.
