P2P网贷公民个人信息保护法律法规探究

摘　　要：P2P网贷借助互联网的快速、方便连接的特征,为优化配置社会闲散资金发挥了一定作用。但也存在征信漏洞等问题,公民个人信息没有得到很好的保护,网贷平台侵犯公民个人信息的事件也频繁曝出。通过比较研究发现,可以向美国借鉴一些经验。网络运营者和行政监管部门作为网络安全最主要的维护者,应充分发挥其作用。在明确角色定位的前提下,政府应加紧建设完善的征信体系。应出台专门性的行政法规,如加快《个人信息保护法》的出台。针对网贷平台中各种侵犯公民个人信息的行为进行规制,加大对于违法行为的惩罚力度,开展重点的治理审查工作。同时在民事、刑事领域以中国宪法为基本原则,制定出一套互相呼应的法律制度,就网络贷款领域的信息漏洞问题做出具有针对性的条款。With the feature of fast and convenient Internet access,P2P net loan has played a certain role in optimizing the allocation of social idle funds.But there are also credit loopholes and other problems,such as citizens'personal information has not been well protected,and the online loan platform violations of citizens'personal information incidents are also frequently exposed.The comparative study found that some experiences can be drawn from the United States.Network operators and administrative regulators,as the most important defenders of network security,should give full play to their role.Under the premise of clear role orientation,the government should step up the construction and improvement of credit information system.Special administrative regulations should be introduced,such as speeding up the introduction of The Personal Information Protection Act.We should carry on the regulation of all violation behaviors of citizen personal information from net loan platform,increase the punishment force of illegal behavior,and carry on the key governance review work.At the same time,taking the Chinese Constitution as the basic principle in the civil and criminal fields,a set of corresponding legal systems should be formulated,and targeted provisions should be made on the problem of information loopholes about network loans.
