摘  要:传统纸质办案模式在人工智能时代的应用空间被极大压缩,存在着流转不便利、使用受限制、技术难助力等局限。全流程无纸化办案可以对诉讼各要素进行电子化和数据化改造,从而提升司法效率,保障司法公正,推动审判体系和审判能力现代化。然而,全流程无纸化办案是个新命题,各地法院在改造过程中,存在形式主义、唯技术论、数据闭环等主客观因素引起的误区。为此,需要在理论层面确立司法规律与信息化规律并重、诉讼效率与诉讼公正并重、数据开放与数据安全并重等改造坐标;在实践层面架构起以全流程的应用场景、多面向的应用主体、深度嵌入的应用模式为核心的“2W1H”应用模型。在此基础上,通过内外互通的数据共享、电子送达的深度落实、数据安全的保护等,助力“信息技术”与“司法审判”的深度融合,充分释放科技司法的潜能。In the era of artificial intelligence,the mode of handling case by the traditional paper has been greatly compressed,with limitations such as inconvenient circulation,limited use and the lack of technology.Paperless handling cases in the whole procedure can transform all elements of litigation electronically and digitally,thus improving judicial efficiency,ensuring judicial justice,and promoting the modernization of trial system and trial ability.However,Paperless handling cases in the whole procedure is a new proposition.In the process of transformation,there are some misunderstandings caused by subjective and objective factors in some courts,such as formalism,technology-only theory and closed-loop data.Therefore,it is necessary to establish the reform coordinates of laying equal stress on judicial rule and information rule,litigation efficiency and litigation justice,data opening and data security at the theoretical level,and establish the"2W1H"application mode with application scene in the whole procedure,multi-oriented application subject and deep embedding application mode as the core at the practical level.On this basis,by means of the internal and external data sharing,the deep implementation of electronic service,data security protection,etc.,we can make"information technology"and"judicial trial"integrate deeply,and fully release the potential of technological judicature.
