摘  要:以《红楼梦》的相关章节为研究对象,与《大清律例》相对照,对薛蟠的两次杀人案件作了较为全面的考察。薛蟠杀人案件事实表明,审判结果与预期之间存在的巨大差异的主要原因,在于当事人的阶级特权、司法裁判权的滥用和审判依据模糊不清。薛蟠杀人案作为清代司法审判制度的缩影,既有消极的一面,如人情错杂、重实体轻程序、极端的“慎讼”思想,也有积极的一面,即强调维护家族和睦和天理人情、法律与道德教化的共同作用、调解优先等,集中体现了清代诉讼制度的一体两面性。清代刑事审判制度依然对当代法制建设有相当大的借鉴意义,现代社会应批判性地继承传统的司法制度和司法理念。Taking the relevant chapters of A Dream of Red Mansions as the research object,this paper makes a comprehensive investigation on Xue Pan’s two homicide cases in comparison with the laws and regulations of the Qing Dynasty.The fact of Xue Pan’s murder case shows that the main reasons for the great difference between the trial result and the expectation lie in the party's class privilege,the abuse of judicial jurisdiction and the unclear trial basis.As a microcosm of the judicial trial system in Qing Dynasty,Xue Pan’s murder case has both negative and positive aspects,such as complex human relationship,emphasis on substance and light procedure,extreme“cautious litigation”thought,and positive side,that is,emphasizing the maintenance of family harmony and natural and human feelings,the joint role of law and moral education,mediation priority,etc.,which embodies the two sides of the litigation system in Qing Dynasty.The criminal trial system of Qing Dynasty is still of great significance for the construction of contemporary legal system.Modern society should critically inherit the traditional judicial system and judicial concept.
