摘 要:法国和日本于20世纪30年代前后,在错综复杂的国际背景下,不顾民国政府在南海的管辖事实,先后占领和开发了南海部分岛礁。二战结束后,国民政府逐步接收被占岛礁,加强管控。在接管过程中,法国和菲律宾提出异议,成为日后争议的缘起。深刻剖析史实,能够析出域外国家侵占我国海疆的基本特征,即当政府战略与产业政策一致、产业领域深耕政府高层时,就存在侵占动力;而当在舆论宣传与外交话语上有优势时,则会对之强化,引起侵占事实发生。In the context of complex international situation,France and Japan occupied parts of the SCS islands and reefs successively in 1930s,disregarding the truth that the government of the Republic of China had owned the rights of competency in SCS.After the World War II,the Republic of China received and controlled the islands and reefs which were occupied by other countries successively.Nevertheless,France and Philippines raised an objection on the affiliation of SCS islands and reefs,which also became the origin of the controversy.By analyzing historical events deeply,we can draw the basic features when outside countries violate territorial waters.When the government strategy and industrial policies has consistency,industry can influence senior government,there is the inner motive power of interference.When there is superiority in the propaganda and diplomatic discourse,it will be strengthened,causing the fact of encroachment.
