刑事政策对疫情期间妨害公务行为刑事司法的导向功能研究

摘　　要：刑事政策对于刑事司法的导向作用主要体现于规范性意见的制定和司法实践对于案件的处理。新冠疫情期间发生的妨害公务违法犯罪行为,可能存在过度强调“从严”面向、机械化理解“从宽”面向等不足,应通过准确理解对“涉疫情”违法犯罪从重处罚的含义和综合考虑案件情况实现依法从宽处理两方面予以调整,以实现宽严相济刑事政策导向作用的优化。The guiding role of criminal policy for criminal justice is mainly reflected in the formulation of normative opinions and the handling of cases in judicial practice.There may be some shortcomings in the current criminal acts of interfering with public affairs during the epidemic period,such as overemphasizing“being strict”and mechanized understanding of“being lenient”.The meaning of severe punishment for“epidemic related”crimes should be adjusted and the case situation to realize lenient treatment should be comprehensively considered to optimize the guiding role of the criminal policy of temper justice with mercy.
