摘  要:就国际投资协定(IIA)中解决投资者与东道国之间投资争端的国际投资仲裁机制面临的"正当性危机"而言,IIA的碎片化无疑是成因之一,而其多边化或区域化则有助于提升IIA条文解释的一致性和仲裁裁决的可预见性。欧盟正在推动IIA投资仲裁机制的多边化,并使其成为联合国国际贸易法委员会的工作议题。我国和一些"一带一路"沿线国家是该议题工作组的成员。以此为契机,我国应推动"一带一路"倡议实施下IIA投资仲裁机制的区域化改革,寻求"一带一路"沿线国家都能接受的改革模式。The fragmentation of International Investment Agreement(IIA) is undoubtedly one of the causes of the"legitimacy crisis"faced by the international investment arbitration mechanism for the settlement of investment disputes between investors and host countries, while its multilateralization or regionalization can help improve the consistency of IIA provisions and the predictability of arbitration awards. The EU is promoting the multilateralisation of the IIA regime and making it a topic of work for the UN Commission on International Trade Law. China and a number of countries along the Belt and Road are members of the Working Group on this topic. Taking this as an opportunity, China should promote the regionalisation of the IIA investment arbitration mechanism under"One Belt and One Road Initiative"and seek a reform model acceptable to those countries along the Belt and Road.
