摘　　要：无障碍已成为国际公认的一项重要权利,而且与其他基本权利的实现密切相关。本文在厘清无障碍概念及发展的基础上,阐述我国无障碍立法的必要性和可行性,从依法治国的基本方略角度探讨无障碍立法在完善法治体系中的重要意义。无障碍立法对于引领全体社会成员正确理解和维护无障碍环境,对于我国残疾人事业和人权事业的发展都具有重要的推动作用。在无障碍立法中,应当参考域外无障碍法例,比较不同的立法模式,建立以权利为本位,以物质无障碍、信息无障碍、社区服务无障碍为主干,强化无障碍环境的监督和管理,完善法律责任,加大违法成本,从而建立和完善具有中国社会主义特色的无障碍法律制度。The right to accessibility,which has become an important internationally-recognized right,is closely related to the realization of other fundamental rights.This article discusses the development of the concept of accessibility and analyzes the necessity and feasibility of the legislation for accessibility.It holds that legislation for accessibility must implement the basic strategy of ruling according to law,and it will be of great significance to improve the socialist legal system with Chinese characteristics.Legislation for accessibility will lead the whole society to establish barrier-free consciousness,which plays an important role in promoting the development of the cause of the disabled and the cause of human rights in China.The experience of foreign accessibility legislation provides a reference for China's accessibility legislation and it is necessary for China to compare different legislative model and absorb advanced extraterritorial experience in legislating accessibility and change the current legislation model.The law on accessibility should be based on human rights,clearly stipulate the key contents of accessibility,including access to the physical environment,access to information and communications,access to other facilities and services open or provided to the public in community,strengthen supervision and administration of accessibility,improve legal liability,and increase the cost of violation of the law,therefore we can establish and improve a legal system of accessibility with Chinese socialist characteristics.
