摘　　要：机构改革的逻辑路径主要是静态的机构调整与动态的职能转变,行使行政职能的行政机关和行政主体属于不同的逻辑范畴。党政融合的机构改革实践为行政主体理论发展提出了新的课题。行政主体是动态性、抽象性、开放性的概念范畴,行政主体理论是行政法治的基础理论,在机构改革中具有重要的理论指导意义。通过对机构改革的理论分析,引入与之逻辑关联的行政主体理论,可发现传统行政主体理论的逻辑错位和现实问题,如静态的行政机关概念范畴狭窄、行为主体权责分离等。针对这些问题,在对相关学说和域外经验分析的基础之上,对行政主体概念范畴的界定与调适、组织形式的分立与统合以及新型党政融合体制中的主体行为属性的甄别等方面进行理论探索,从而拓宽行政主体理论的研究视野,对机构改革在现实实践中面临的新课题进行理论回应。The logical path of institutional reform is mainly static institutional adjustment and dynamic functional transformation.The administrative organs and administrative subjects exercising administrative functions belong to different logical categories.The practice of the reform of the party and the government has put forward a new subject for the development of the theory of administrative subject.Administrative subject is dynamic, abstract and open concept category.The theory of administrative subject is the basic theory of administrative rule of law, and it has important theoretical guiding significance in the reform of institutions.Through the theoretical analysis of institutional reform.Through the theoretical analysis of institutional reform, this paper introduces the theory of administrative subject which is logically related to it, and points out the logical dislocation and practical problems of traditional administrative subject theory.For example, the concept of static administrative organs is narrow in scope and mainly in practice.In response to these problems, on the basis of an analysis of relevant doctrines and extraterritorial experience, definition and adjustment of the concept category of administrative subject, the separation and integration of organizational form and the characteristics of subject behavior in the new system of party and government integration.Thus, it broadens the research field of the theory of administrative subject, and gives a theoretical response to the new task of institutional reform in practice.
