论类型化视野中气候资源的法律属性

摘　　要：气候资源作为新类型资源,其开发利用方面的法制发展方兴未艾,且引发了"理论争鸣",并存在"双重调整"问题。在明确"气候"特征的前提下,将"泛气候资源"类型化为"强地缘性气候资源"、"弱地缘性气候资源"、"混合地缘性气候资源"三类。"强地缘性气候资源"的综合特征决定其法律属性为民法一般意义上的"物";"弱地缘性气候资源"属于"公众共有物";"混合地缘性气候资源"则视其应用场境不同,分别属于前者之一。这为"理论争鸣"和"双重调整"提供了解决、解释问题的共同"钥匙",有利于更为精准地进行气候资源立法,有利于促进气象法体系和自然资源法制的科学、高效发展。As a new type of resources,the development of legal system in the exploitation and utilization of climate resources is in the ascendant,which has led to"theoretical contention"and"double adjustment".On the premise of defining the characteristics of"climate",the"pan-climatic resources"are classified into three types:"strong geo-climatic resources","weak geo-climatic resources"and"mixed geo-climatic resources".The comprehensive characteristic of"strong geographical climate resources"determines its legal attribute as"thing"in the general sense of civil law."Weak geo-climatic resources"belong to"public Commons";"Mixed geo-climatic resources"belong to one of the former according to their different application fields.This provides a common"key"to solve and explain the problems for"theoretical contention"and"double adjustment",which is conducive to more accurate climate and resource legislation and to the scientific and efficient development of meteorological law system and natural resource law system.
