摘 要:我国行政法规范与刑事法规范并行的二元违法立法模式,是确定行政不法与刑事不法范围、关系的法源所在。在我国立法模式下,行政不法与刑事不法的对象、范围均具有不对称性,均需区分交叉部分与独立部分。行政不法与刑事不法规制对象的交叉部分即规制对象相同并不意味规制范围相同,需要进一步通过规范保护目的区分行政不法与刑法不法范围的交叉部分与独立部分。讨论行政不法与刑事不法关系必须建立在行政不法与刑事不法规制范围交叉部分的基础上,行政不法与刑事不法是质的差异,质的差异不会违反法秩序统一;对于规制对象与规制范围的独立部分,由于仅存在行政法规范或刑事法规范各自的单方评价,不存在违反法秩序统一与否的问题。The dual illegal legislation mode of administrative law and criminal law in China is the source of law to determine the scope and relationship between administrative illegality and criminal illegality.In the legislative mode of China,the regulatory objects and regulatory scopes of administrative law and criminal law are asymmetric,so it is necessary to distinguish the cross part and the independent part.The intersection of administrative law and criminal law does not mean that the regulatory scopes of administrative law and criminal law are the same.It is necessary to further distinguish the cross part and independent part of the regulatory scope of administrative law and criminal law by regulating the purpose of protection.The discussion on the relationship between administrative illegality and criminal illegality must be based on the intersection of administrative law and criminal law.Administrative illegality and criminal illegality are qualitative differences,and qualitative differences will not violate the unity of legal order.As for the independent part of the object and scope of regulation,there is no problem of violating the unity of law order because of the unilateral evaluation of administrative law or criminal law.
