新形势下立法明确“警察武力”概念的必要性研究

摘　　要：学术研究最基础也是最关键的一步便在于科学厘清概念。在总结、分析诸多文献资料的基础上,结合执法实践,对“警察武力”的定义与核心概念进行初步研究,并就新形势下明确“警察武力”概念的必要性展开深入分析。警察武力是人民警察在执法活动中为了消除冲突与对抗等阻碍因素以及其他危险因素,或者对潜在的阻碍因素和危险因素进行震慑、制止,使执法对象服从控制所实施或预备实施的合法且必要的强制手段的总称,其核心概念是控制。当前新形势下确立“警察武力”这一概念是时代发展的迫切需要,有利于其更好地在执法实践中发挥作用,同时也有利于实战化训练的开展。The most basic and critical step in the research of related fields is to clarify the concept scientifically.On the basis of summarizing and analyzing many literature materials and combining with law enforcement practice,this paper makes a preliminary study on the definition and core concept of“police force”,and analyzes the necessity of establishing this concept.Through the study,it is found that police force is a general term for the people’s police to eliminate obstacles such as conflict and confrontation and other risk factors in law enforcement activities,or to deter potential obstacles and risk factors.The core concept is control.The establishment of the concept of“police force”under the current new situation is an urgent need for the development of the times,which is conducive to its better role in law enforcement practice,and also conducive to the development of practical training.
