数字音乐版权独家授权的反垄断法规制逻辑及展开

摘　　要：网络经济时代,知识产权法在化解数字音乐版权独家授权垄断违法风险过程中存在一定的局限性,而反垄断法在维护数字音乐市场有序竞争和高效创新方面却展现出明显优势,奠定了数字音乐版权独家授权反垄断法规制的逻辑起点。承认反垄断法规制的正当性并不意味着从根本上否定数字音乐版权独家授权模式。数字音乐版权独家授权的反垄断法规制应以谦抑理念为指导,践行约束与促进并举的规制思路,配合以理性的反垄断分析框架、科学的规制工具和柔性的救济机制,以期在市场竞争规律和反垄断法律规则的双向互动中实现数字音乐市场有序竞争、创新繁荣。In the era of network economy,the intellectual property law has some limitations in the process of resolving the illegal risks of exclusive licensing and monopoly of digital music copyright,while the anti-monopoly law shows ob⁃vious advantages in maintaining orderly competition and efficient innovation in the digital music market,laying a logi⁃cal starting point for the regulation of the anti-monopoly law of exclusive licensing of digital music rights.The recogni⁃tion of the legitimacy of anti-monopoly law does not mean the fundamental denial of the exclusive licensing mode of digital music copyright.The anti-monopoly legal system of exclusive authorization of digital music copyright should be guided by the concept of restraint and modesty,practice the regulatory thinking of promoting and restraining simultane⁃ously,and cooperate with the rational anti-monopoly analysis framework,scientific regulatory tools and flexible relief mechanism,so as to realize orderly competition,innovation and prosperity of digital music market in the two-way inter⁃action of market competition rules and anti-monopoly legal law.
