摘　　要：通过一起非医学需要胎儿性别鉴定及终止妊娠手术案件的评析,梳理案件查处中存在的问题,探讨针对该类违法案件行为的证据认定、法律适用、法律裁量等相关问题,法律规范适用中遇到的新情况和新问题,总结办案过程中的工作经验,研究有效对策,为进一步加大对“两非”违法行为进行严厉的打击,维护法律尊严。Through analyzing a case on a fetus’s sexual examination without Medical Needs and an operation per⁃formed to terminate pregnancy,this paper sorts out the problems existing in the case’s investigation and prosecution,probes into the evidences’ascertaining,laws’application,laws’discretion and other issues of the illegal activities in similar cases,grasps the new situation and problems in the application of laws and regulations,summarizes the working experience,stud⁃ies the effective countermeasures so as to take stronger measures agains“t two illegal activities”and defend legal dignity.
