瑞典畜禽养殖许可制度研究及其启示

摘　　要：我国畜禽养殖行业中的规模化养殖单位,养殖畜禽品类繁多且污染产生量巨大,而现行的排污许可证申请制度却无法起到畜禽养殖污染防治的效果。为制定更加具体的最佳可行技术标准,完善畜禽养殖行业排污许可证的申请与核发程序,故而通过域外比较瑞典相关立法规定提供参考。瑞典自其环境保护事业开展半个世纪以来,已经形成了由畜禽养殖许可证申请人提交环境影响报告,郡行政议事会同时参考畜禽养殖业最佳可行技术标准,审核资质并发放许可证的畜禽养殖许可制度体系。借鉴瑞典的立法经验,我国畜禽养殖业污染防治应以预防为主,并快相关专项立法的制定进程,以建立畜禽养殖行业排污许可综合管理制度。The large-scale breeding units in China's livestock and poultry industry have many kinds of livestock and poultry,and the amount of pollution is huge.However,the current pollution permit application system cannot achieve the effect of livestock and poultry pollution prevention.In order to formulate more specific best feasible technical standards and improve the application and issuance procedures of pollutant discharge permit for livestock and poultry industry,this paper provides a reference by comparing the relevant legislative provisions of Sweden outside the region.Since the development of environmental protection in Sweden for half a century,the livestock and poultry breeding license system has been formed,in which the environmental impact report is submitted by the livestock and poultry breeding license applicant,and the county administrative council reviews the qualification and issues the license referring to the best feasible technical standards of livestock and poultry breeding industry.Drawing lessons from the legislative experience of Sweden,the prevention and control of pollution in China's livestock and poultry industry should focus on prevention,and speed up the formulation process of relevant special legislation,so as to establish the comprehensive management system of pollutant discharge permit in livestock and poultry industry.
