地方金融监管体制改造论:矛盾、路径与方案

摘　　要：现行地方金融监管体制下,金融监管与金融发展间的矛盾、属地监管与无界经营间的矛盾、保护金融消费者与防控金融风险间的矛盾,以及分级监管与监管能力间的矛盾突显,其直指地方金融监管体制的"属地性""统一性"和"分级性"。因此,对地方金融监管体制改造即为在对"监管主体""监管分工""监管层级"三大变量校定的基础上,建构由中央督察机制、以中心部门为主导的审慎监管网络、赋能前端的行为监管系统、监管双峰的冲突隔离墙与协同机制四大版块所组成的纵横联动的双峰监管系统。Under the current local financial supervision system,the conflict between financial supervision and financial development,the conflict between territorial supervision and unbounded operation,the conflict between the protection of financial consumers and the prevention and control of financial risks,the conflict between hierarchical supervision and supervision capability are highlighted,Which stem from the"territoriality","unity"and"hierarchy"of the local financial supervision system.Therefore,the reform of the local financial supervision system is to construct the"twin peaks"supervision system with vertical and horizontal linkage composed of four sections:the central supervision mechanism,the prudential supervision network led by central departments,the conduct supervision system enabling frontline,the wall separating conflicts and coordination mechanism of"Twin Peaks",which is on the basis of the calibration of the three variables of"supervisory subject","supervision division"and"supervision hierarchy".
