摘　　要：国家公布的《关于进一步加强塑料污染治理的意见》,旨在通过规范我国塑料废物的回收利用活动建立塑料污染长效治理机制。这是我国历史上第二次大规模应对塑料污染的国家行动,标志着我国在限塑方面步伐继续加大。以循环经济法为视角,重点分析“限塑新政”的立法背景与政策内涵,探寻该政策在我国塑料污染治理中发挥的独特作用。通过对“限塑令”的再审视,探讨其在塑料污染治理方面尚存的缺陷;通过对德国部分立法经验的分析借鉴,从设定塑料具体回收率、推行EPR制度等方面提出完善我国限塑法律制度的对策建议。旨为走可持续发展之路,化解我国“白色污染”难题,实现塑料废物的循环再生利用。The Opinions on Further Strengthening the Control of Plastic Pollution is aimed to establish a long-term governance mechanism for plastic pollution through standardizing the recycling activities of plastic waste in China.It is the second large-scale national action to deal with plastic pollution in the history of China,which marks that the pace in plastic restriction continues to increase in China.From the perspective of circular economic law,the legislative background and policy connotation of the“new deal of restricting plastic products”are analyzed emphatically,and the unique role of the policy in the plastic pollution control is explored.The defect of“plastic limit order”in the governance of plastic pollution is discussed through the reexamination of it.And by analyzing and referencing some legislative experiences in Germany,countermeasures and suggestions are proposed of the perfection of legal system of plastic restriction in China from aspects of setting specific plastic recovery rate,and implementing extended producer responsibility(EPR)system,etc.It is aimed to take the road of sustainable development,resolve the problem of“white pollution”in China,and realize the recycling of plastic waste.
