摘　　要：劳动与正义问题是马克思主义哲学不可回避的重大的理论与现实问题。分析马克思主义关于马克思正义问题的论争的实质在于如何理解马克思的正义概念及其对资本主义的批判。马克思正义概念涉及两种规定:一是法权维度的正义概念;二是价值维度的正义概念。马克思正是从这两种规定出发,一方面认为资本主义具有非正义性,但同时具有暂时的表面合理性,另一方面又承认现实中正义问题所包含的文化价值维度,对资本主义所导致的不正义现象进行了彻底的批判。将这两种规定性统一起来的正是马克思的劳动正义观。劳动正义是现代社会正义问题的时代主题,关键在于厘清资本主义生产方式与劳动过程的边界及其哲学效应。劳动正义问题的解决需要一定的社会修正,其途径就是保障劳动幸福权、提高劳动幸福程度。因此,保障劳动幸福权是现代社会最大的劳动正义。The issue of labor and justice is a major theoretical and practical issue that can not be avoided in Marxist philosophy. Analyzing the essence of the Marxist debate on Marx’s justice issue lies in how to understand Marx’s concept of justice and its criticism of capitalism. Marx’s concept of justice involves two kinds of provisions: one is the concept of justice in the dimension of legal power;the other is the concept of justice in the dimension of value. Marx is based on these two regulations.On one hand,he believed that capitalism was unjust but had temporary superficial rationality. On the other hand,he acknowledged that the cultural value dimension contained in justice issues in reality had a negative impact on capitalism. The phenomenon of injustice was thoroughly criticized. It is Marx’s labor justice view that unifies these two kinds of regulations. Labor justice is the theme of modern social justice issues. The key is to clarify the boundary between the capitalist mode of production and the labor process and its philosophical effect. Therefore,the solution to the problem of labor justice requires certain social corrections. The way is to protect the right to labor happiness and improve the degree of labor happiness,so guaranteeing the right to labor happiness is the greatest labor justice in modern society.
