论山西醋文化的立法保护与管理

摘　　要：山西醋文化不仅具有多重的价值意义,还承载着山西深厚的历史文化。山西醋文化具有历史悠久、底蕴深厚、资源丰富、特色鲜明等得天独厚的优势。为了有力保护与管理山西醋文化,进而推动山西省经济稳健发展与文化不断繁荣,有必要就山西醋文化制定地方性法规。山西醋文化的立法保护与管理的第一出发点与最终归宿是"行善治""保民生"以及"促发展"。就山西醋文化的立法保护与管理而言,可以从科学准确定义山西醋、规范山西醋的生产工艺、高度重视集体商标和地理标志产品专用标志、合理扶持与发展醋产业、明晰有关行政执法主体及其职能五个维度着手。Shanxi vinegar culture not only has multiple value significance, but also carries the deep historical culture of Shanxi.Shanxi vinegar culture has a long history, with rich resources, distinctive characteristics and other advantages. In order to effectively protect and manage the vinegar culture of Shanxi, and then promote the steady economic development and cultural prosperity of Shanxi Province, it is necessary to formulate local laws and regulations on Shanxi vinegar culture. The starting point and final destination of the legislative protection and management of Shanxi vinegar culture are"good governance","protecting people’s livelihood"and"promoting development". As far as the legislative protection and management of Shanxi vinegar culture is concerned,we can start from five dimensions: defining Shanxi vinegar scientifically and accurately, standardizing the production process of Shanxi vinegar, attaching great importance to the special marks of collective trademark and geographical indication products, reasonably supporting and developing vinegar industry, clarifying the main body of administrative law enforcement and its functions.
