浅论民法典合同编体系化的发展与适用

摘　　要：《民法典》合同编在民法典中占据526条法律条文,具有举足轻重的地位,更加具有公私届分、总分结合、价值均衡的特点。《民法典》合同编在内在体系上相较于以往的合同法更加注重意思自由、权益保障和交易安全,外在体系上完成了对债法体系的重整和一些理论概念的区分言明。在不设立债法总则的情况下,合同通则代行债法总则的功能,使得合同通则地位更加复杂,合同编涵盖范围更加广阔,其他各编对合同编相关规定的正确适用尤为重要。The contract part of Civil Code occupies 526 legal provisions in the Civil Code,and plays an huge role.It has the characteristics of public-private division,major-minor combination and value balance.Compared with the contract law in the past,the contract part of Civil Code pays more attention to the freedom of will,the protection of rights and interests and the security of transaction in the internal system,and completes the reorganization of the debt law system and the differentiation of some theoretical concepts in the external system.In the absence of the general provisions of the law of obligation,the functions of the general principles of contract can be on behalf of the general provisions of the law of obligation,which makes the status of the general principles of contract more complex and the scope of the contract part more extensive.The other parts of the contrat parts is particularly important for the correct use of relevant provisions.
