生态环境之法律内涵探究--以检察公益诉讼为视角

摘　　要：生态环境“ecological environment”,因生命活动其中而得名,是地球环境发展到一定历史阶段由自身衍生又构成自身的有机组成部分,是各种生命有机体孕育其中的时、空、物、事四维同构的各种构成要素不断演化的场域。法律上的“生态环境”在法律规范形态上有九种表现形式,实质是表现为社会公共利益的法律客体或法律保护对象。检察公益诉讼视域的生态环境,其法律内涵是指法律保护的生态环境本身,是与人身、财产等法律客体相并列的狭义法律概念;其外延不仅指法律保护的生态环境本身,还包括法律体系内与生态环境相关的环境、自然环境、生活环境、污染防治等领域的规范内容。The"Ecological Environment",named after life activities,is an organic component of the earth's environment that has developed to a certain historical stage,derived from itself,and constitutes its own organic component.It is the four dimensions of time,space,object,and matter in which various living organisms breed.Also,it is a field in which various constituent elements of isomorphism are constantly evolving.The legal"Ecological Environment"has nine manifestations in the form of legal norms,and in essence it is the object of law or the object of legal protection of the social public interest.The legal connotation of the ecological environment in the procuratorial public interest litigation refers to the ecological environment protected by law itself,which is a narrow legal concept juxtaposed with legal objects such as person and property.Its extension not only refers to the ecological environment protected by law itself,but also includes law regulated content in the fields of environment,natural environment,living environment,pollution prevention and control related to the ecological environment in the system.
