总体国家安全观视域下安全生产法律体系的推进路径研究

摘　　要：随着应急管理部的建立,涵盖安全生产监督管理的国家应急管理制度正逐渐形成。以应急管理法律体系为核心,统领安全生产法律体系,是适应设计的自然选择。由于应急管理法与安全生产法的制度特征和规范内容存在诸多差别,短时间内无法完美结合。如何理顺两者之间的衔接关系,本文另辟蹊径,打破了传统部门法研究范式,建立了新的思维框架。运用领域法学的研究范式构建符合“国家安全观”的安全生产法律体系,这是适应制度安排的合理选择。同时,在安全生产法中要解决主体责任落实等核心问题,只能借助领域法的研究范式,提出具有实践性的方案。With the establishment of the Ministry of Emergency Management,a national emergency management system covering the supervision and management of production safety is gradually taking shape.Taking the emergency management legal system as the core and leading the legal system of productionsafety seems to be the natural choice to adapt to this design.However,the emergency management method and the safety production law can't be combined perfectly in a short time due to thedifferences between the emergency management law and the production safety law in terms of system characteristics and the standard content.Aimed at the question of how to rationalize the connectrion between the two relations,this paper finds a new way to break the traditional research paradigm of departmental law and establish a new thinking framework.It is a reasonable choice to construct the legal system of safe production in line with the"national security concept"by using the research paradigm of field law.At the same time,in order to solve the core problems such as the implementation of the main responsibility in the production safety law,we can only use the research paradigm of the field law to put forward practical solutions.
