理念再定义与程序衔接:未成年人社区矫正的路径优化探析

摘　　要：社区矫正制度在规避未成年人因监狱服刑而引发的“交叉感染”风险以及使其顺利回归社会方面具有独特价值。虽然目前我国在关于未成年人社区矫正的立法规定以及实践运行方面均取得了一定的发展,但从整体来看,该项制度的运行仍存在制约因素。优化未成年人社区矫正的运行机制,一方面需要重塑矫正理念,以“柔性化”的社会关护与“刚性化”的规制与惩罚理念相结合,并将其贯穿于制度适用的全过程;另一方面则需要整合现有的诉讼程序资源、完善《刑事诉讼法》与《社区矫正法》的相关规定,在规范层面对未成年社区矫正制度进行细化。最终实现促进未成年人社区矫正与刑事诉讼程序的有效对接,改善未成年人社区矫正制度适用困境之局面。Community correction,as a way of penalty execution different from imprisonment correction,has unique value in correcting minors'bad behavior and making them return to society smoothly.Although the legislation and practice of community correction of juvenile offenders had made some progress of China,the operation of the system still has some constraints.In order to perfecting the system of community correction of juvenile offenders,on the one hand,we need to reshape the concept of correction,combine"flexible"social care with"rigid"regulation and punishment concepts,and apply it to the whole process of system operation;on the other hand,we need to integrate the existing procedural resources and improve the relevant provisions of the criminal procedure law and the community correction law,refine the system of community correction of juvenile offenders at the standard level.Ultimately,to promote the effective connection between the system of community correction of juvenile offenders and criminal procedure,and to improve the dilemma of the application of the system.
