摘 要:当前“互联网+”环境具有行业融合、信息聚合的特点,同时带来了商品和服务种类的叠合交叉、界限模糊,更有新型商品和服务类别不断涌现,致使《类似商品和服务区分表》的局限性和滞后性日益凸显。商品和服务类别认定标准不一成为我国商标保护的一大难题。应当明确《类似商品和服务区分表》在行政审查和司法保护中重要的参考效力,及时更新完善。同时聚焦商品服务本身,以相关公众认知为准,综合考察所有相关因素,以应对社会发展带来的挑战。The current “internet plus” environment bears the characteristics of industry integration and information aggregation, which has brought about overlapping and blurring of goods and services, as well as the continuous emergence of new types of goods and services. As a result, the limitations and lag of the Chinese Classification of Goods and Services have become increasingly prominent. Different standards for the classification of goods and services have become a major drag on the trademark protection in China. Therefore, the important reference effect of the Chinese Classification of Goods and Services in administrative review and judicial protection should be clarified and updated in a timely manner. At the same time, in order to address the challenges brought by the social development, more effors should be focused on the goods and services themselves, and a comprehensive investigate into all factors related to goods and services based on relevant public perception should be carried out.
