双重人权属性下的义务教育受教育权

摘  要:义务教育受教育权是一项基本人权,兼具道德属性和法律属性,两种属性既有冲突,又有融合,对于二者的正确理解有助于对义务教育受教育权的理论认识,也有助于推动义务教育阶段的制度建设,完善相关的政策法律。Right to education in compulsory education is one of human rights, so it is also entitled with two qualities: that of law and that of moral. The two qualities see conflicts in one another;meantime, they also share opportunities to be combined together. A good comprehension towards the issue helps to explore the research of right to compulsory education, to promote the institute and the policy in compulsory education.
