流动摊贩的治理困境及规范路径

摘　　要：目前,我国城管与摊贩的“追逐”屡见不鲜,且易发生冲突,其产生的原因引人深思。文章深入分析了流动摊贩法律治理陷入困境的主要原因,即流动摊贩基本权利与公共利益之间的冲突、城市管理部门对待流动摊贩的执法方式不当、行政决策程序中公众参与缺失等,并提出要实现对流动摊贩的有效治理,应该以立法的形式明确流动摊贩的相关权利、创新对流动摊贩监管的执法方式、构建公众参与行政决策的有效机制等途径寻求出路。Presently,it is common in China that street vendors play the game of cat and mouse with council police on the streets,causing frequent conflicts between them.It is of great value to examine the reasons behind this trend.Based on the analysis of various situations in the process of administration on these merchants,it has been found that the dilemma of governance by law on street vendors results from three principal factors:the clash between the sellers’basic rights and public interests,the inappropriate way enforcement of law towards these vendors by city council,and the lack of public participation in the administrative decision-making process.Currently,to realize the effective management on street vendors,it is imperative to confirm relevant rights of vendors in legislation,to innovate the methods of supervision on street merchants,and to build an effective mechanism for the public to participate in administrative decision-making.
