摘 要:我国现行城镇管道燃气特许经营制度把燃气销售和燃气输送进行一体化垄断经营,不仅阻碍了潜在竞争者进入燃气销售市场,也不利于经营性用气主体充分、经济地获取燃气,且容易导致政府监管职能的异化。随着城镇燃气供应领域公益性的减弱、自然垄断理论的变迁、政府干预方式的调整,改革我国城镇燃气特许经营制度的条件逐渐成熟。城镇管道燃气特许经营制度的转型需要分步推进,一方面要依法限制城镇管道燃气特许经营制度,另一方面要全面调整城镇管道燃气特许经营制度。The current urban pipeline gas franchise system in China integrates gas sales and gas transmission into a monopoly operation,which not only hinders potential competitors from entering the gas sales market and the commercial gas users from obtaining gas fully and economically,but also easily leads to the alienation of the government's regulatory functions.With the weakening of public welfare in the field of urban gas supply,the change of natural monopoly theory and the adjustment of government intervention mode,the conditions for reforming the urban gas franchise system in China are gradually ripe.The transformation of urban pipeline gas franchising system needs to be promoted step by step.On the one hand,the urban pipeline gas franchising system should be restricted according to law;on the other hand,the urban pipeline gas franchising system should be completely adjusted.
