基于区块链的互联网平台型企业联盟风险规制机制与框架

摘　　要：随着互联网经济的日益发展壮大,互联网平台型企业在我国经济社会中的地位越来越重要。但与此同时,互联网平台型企业与消费者、供应商、合作方或竞争方的联盟风险日益凸显,产生的负面效应也不断增加,迫切需要加以规制。区块链作为开放式创新的新模式,可用于多种风险的管控和规制。联盟链作为区块链的三种典型模式之一,比较适合用来对互联网平台型企业联盟风险进行规制。为实现合理的风险分担和有效的风险防范,实现联盟企业多方共赢,应针对动态联盟、合资联盟、契约联盟等不同类型的互联网平台型企业联盟,剖析各类型联盟核心企业与外围企业之间的专业分工与组织协作关系,明确各类型联盟存在的信用风险、契约履行风险、数据流动风险等,通过文本挖掘对底层基础协议条款进行分析和主题分类,根据交易关系对底层数据进行梳理,构建数据流程,确定数据可上链标准评估体系,对可上链数据进行评估,进而从数据治理、技术治理、组织治理层面入手,设计合理可行的互联网平台型企业联盟风险治理体系。换言之,就是要坚持技术与规则并重,构建协作共治体系,引导并推动区块链开发者及平台型企业加强行业自律,落实安全责任;就是要以数据为抓手,把法律和规则治理落实到互联网平台型企业联盟规制中,推动联盟链安全有序发展。With the development of Internet economy,Internet platform enterprises are playing more and more important role in China’s economic society.At the same time,risks relating to the alliance of Internet platform enterprises and consumers,suppliers,cooperators or competitors are increasingly prominent;and the negative effect is increasing,which need to be regulated.Blockchain,the new pattern of open innovation,can be used to control and regulate different types of risks.Alliance chain,one of the three classical patterns of blockchain,can be suitably applied to the risk regulation of Internet platform enterprise alliance.To realize the rational risk sharing and effective risk prevention,and the win-win situation among alliance enterprises,we should divide Internet enterprise alliances into such groups as dynamic alliance,joint venture alliance,and contract alliance,analyze the labor division and organizational cooperation relation between the core and outer enterprises,clarify the credit risk,contract performing risk,and data flow risk;we can also analyze basic agreement terms and theme classification,sort out the underlying data according to transactional relation,establish data process,formulate the evaluation system,design the rational and feasible risk regulation system for Internet platform enterprise alliance from the level of data regulation,technology regulation,and organization regulation.In other words,we should pay attention to both technology and regulation,construct the coordinated regulation system,guide and promote self-discipline,and clarify the accountability for safety;and we should also take data as the center,apply law and regulation to Internet platform enterprises alliance regulation,and promote the orderly development of alliance chain.
