民营企业家犯罪的生成机制与治理

摘　　要：对民营企业保护失衡的立法反应,表面化、泛刑化和强制措施扩张化的司法反应,以及负面舆论评价的非正式社会反应,共同作用着民营企业家的犯罪生成。犯罪现象的背后是刑法规范设立和适用的失调,规范失调的背后成因则可用社会控制理论、标签理论加以揭示。除了确立对民营企业家同等保护的刑事政策外,还应引入刑事合规制度,释放刑法的预防性保护功能,激励企业参与到预防犯罪的合作模式中。The crimes committed by private entrepreneurs may be caused jointly by several different responses including legislative response with imbalance protection for private enterprise,judicial response with extensive punishment and overused compulsory measures,and informal social reaction with negative public opinion evaluation.The maladjusted establishment and application of criminal law norms which can be interpreted by social control theory and label theory will lead to crimes.Therefore,in addition to establishing the criminal policy with equal protection concept,the criminal compliance system should be introduced,releasing the preventive protection function of criminal law,so as to encourage enterprises to take an active joint part in preventing crimes.
