从《征信业管理条例》看个人隐私权保护缺失与完善

摘　　要：[目的/意义]旨在为完善个人隐私权保护提供参考。[方法/过程]分析《征信业管理条例》条款存在的问题,使得征信业务环节遭遇的隐私权问题越来越严重的情况。并在分析其存在的不足基础上,提出了有针对性的改进举措。[结果/结论]《征信业管理条例》条款存在规定笼统、约束力有限、又缺乏相应实施细则和配套法律法规等问题,这对当下征信业务工作中如何规范管理、保护、使用个人信息具有重要的借鉴意义。[Purpose/significance]The paper is to provide references for improvement of personal credit information.[Method/process]The paper analyzes the existing problems of the clause in regulations on the administration of credit reference industry,which makes more and more serious problem of privacy in the credit investigation business;and puts forward targeted improvement measures based on the analysis of its shortcomings.[Result/conclusion]There are some problems in the provisions of the Regulations on the Administration of Credit Reference Industry,such as general provisions,limited binding force,lack of corresponding implementation rules and supporting laws and regulations,which have important reference significance for how to regulate the management,protect and use of personal information in the current credit reference business.
