《重庆市医疗机构管理条例》修订的回顾与反思

摘　　要：由于原《重庆市医疗机构管理条例》中医疗机构审批权限划分不合理、行政许可程序不规范、医疗机构设置规划作用异化和监督管理手段不完善等问题,2012年重庆市启动了修订工作,在下放审批权限、细化审批程序、强化规划引领、放宽资本准入等方面进行了创新尝试。由于国务院1994年颁布的《医疗机构管理条例》作为上位法一直没有进行过实质性修改,重庆的上述突破性立法工作面临着较大的争议,经过重庆市人大常委会四次审议才最终通过,但重庆的诸多制度创新最终在全国范围内得到广泛效法。本文不仅回顾了《重庆市医疗管理条例》修订时面对的问题、进行的创新,也展示了修订后的效果,以期为促进医疗机构的精细化监管提供参考。Because the former Regulation on the Administration of Medical Institutions in Chongqing had such problems as unreasonable division of the access approval of medical market,the licensing procedures yet to be refined,the distorted function of the medical market access'planning,and the flawed supervision.In 2012,Chongqing launched its revision,taking some innovative measures such as the delegation of approval power,refinement of approval procedures,improvement of the medical institutions'planning,increased market share of private capital and so on.However,since National Regulation on the Administration of Medical Institutions promulgated by the State Council in 1994 as the higher norms had not been substantially revised,Chongqing's revision of 2012 faced the great controversy and the new regulation was passed even after four times of deliberation.But the Chongqing's institutional innovations have been followed by many Chinese provinces and cities.This article not only reviews various issues during the revision,but also presents the achieved outcomes,which can be served as a reference for the improvement of medical institutions'administration across China.
