新公共性的重构:协商对话视阈下的城市社区公共纠葛治理研究

摘　　要：新时代我国社会的主要矛盾已经转化为人民日益增长的美好生活需要和不平衡不充分的发展之间的矛盾。为满足基层群众日渐强烈的治理需求,社会治理重心向基层倾斜。城市基层治理作为国家治理的一部分,社区作为城市的基本生活单元,其治理的好坏也关系着居民美好生活目标的实现。随着社区治理主体的日渐多元化以及主体间利益的复杂化,社区公共事务治理中产生的公共冲突逐渐从宏观层面转向微观层面,宏观表现为行政机制与自治机制的冲突,而微观指的是业委会与居委会的自治矛盾以及业主自治行为之间的“公共纠葛”现象。因此,为满足社区公共纠葛治理中居民对于协商对话的强烈需求,应以社区业委会和居委会两大自治组织为基础,重构社区管理和自治的公共边界,通过治理主体间的对话与协商来化解社区中的公共纠葛,建设合法有序的协商对话机制。In the new era,the principal contradiction in our society has been transformed into one between unbalanced and inadequate development and the people’s ever-growing need for a better life.In order to meet the increasingly strong governance need of the grass-roots,the focus of social governance is tilted towards the grass-roots.Urban grass-roots governance is a part of national governance,and communities are the basic living units of cities,so the quality of governance is also related to the realization of residents’goals of a better life.With the increasing diversification of community governance subjects and the complexity of the interests among them,the public conflict in community public affairs governance has gradually shifted from the macro level to the micro level.Macroscopically,it shows the conflict between administrative mechanism and autonomous mechanism.Microscopically,it shows the contradiction between the committee of house oweners and the neighborhood committee and the phenomenon of public entanglements between the autonomous behavior of house owners.Therefore,this paper holds that in order to meet residents’demand for negotiation and dialogue in community governance of public entanglements,it is necessary to reconstruct the common boundary of community management and autonomy based on the committee of house owners and neighborhood committee of the community.Then through the negotiation and dialogue between the governing bodies,we can resolve the public entanglements in the community and build a legal and orderly negotiation and dialogue mechanism.
