摘 要:行政合同已成为一种新型的行政管理方式,对于提升政府管理效能、实现行政任务具有重要作用。但由于中国缺乏统一的行政合同立法、公私法学者对行政合同概念争论不休、各地方政府对行政合同的规定形态多样,导致中国对行政合同概念的认知陷入混乱,行政合同规制难以形成自洽体系。解决中国行政合同法制面临的问题,应当完成行政合同基本概念的重整,并以此为切入点促进公私法学界关于行政合同认知的共识,进而凝聚理论界和实务界力量推动行政合同统一立法,推动行政合同在社会共治新时代发挥更大作用。Administrative contracts have become a new type of administrative management,which plays an important role in improving government management efficiency and fulfilling administrative tasks.However,due to the lack of unified administrative contract legislation in our country,public and private law scholars have been arguing about the concept of administrative contract and various local governments have diversified forms of administrative contract regulations,which has led to confusion about the concept of administrative contract and difficulty of forming a self-consistent administrative contract regulation system in our country.To solve the dilemma faced by the legal system of administrative contracts in our country,we should first complete the reorganization of the basic concepts of administrative contracts,and use this as a breakthrough to achieve a consensus on the understanding of administrative contracts in the public and private law circles.Then unite the theoretical and practical circles to promote the unified legislation of administrative contracts which will play a greater role in the new era of social co-governance.
