突发重大传染病疫情防控中个人数据公开披露的困境及其破解——以新冠病毒肺炎疫情防控为例

摘　　要：我国突发重大传染病疫情防控中个人数据公开披露的相关配套规则尚不完善,这直接影响了疫情防控工作中个人数据公开披露的合理性及规范性,不利于疫情防控工作的高效开展和公民个人隐私的必要保护。新冠病毒肺炎疫情防控中,个人数据公开披露的困境主要体现在个人数据公开披露不够集中、脱敏处理标准各异及监督机制不完善三个方面。为此,有必要通过构建统一规范的个人数据公开披露平台、建立分类分级的个人数据公开披露机制、完善个人数据公开披露的监督机制来优化突发重大传染病疫情防控中个人数据的公开披露机制。此外,有必要对突发重大传染病疫情防控中公开披露的个人数据进行后续控制,遵循目的限定原则及数据最小必要原则,以保障国家公共卫生安全、保护公民隐私利益为目的对个人数据的留存进行综合考量。The relevant supporting rules for public disclosure of personal data in the prevention and control of major infectious diseases in China are not yet perfect,which directly affects the rationality and standardization of public disclosure of personal data in the prevention and control of epidemic diseases,and is not conducive to the efficient development of prevention and control of epidemic and the effective protection of citizens’personal privacy.In the prevention and control of COVID-19,the predicament of public disclosure of personal data is mainly reflected in three aspects:insufficient public disclosure of personal data,different desensitization processing standards,and imperfect monitoring mechanisms.To this end,it is possible to optimize the public disclosure mechanism of personal data in the prevention and control of sudden major infectious diseases through the establishment of a unified and standardized platform for public disclosure of personal data,the establishment of classified public data disclosure mechanisms,and the improvement of the supervision mechanism for public disclosure of personal data.In addition,it is necessary to carry out follow-up control on personal data that is publicly disclosed in the prevention and control of sudden major infectious diseases,follow the principle of limited purpose and the principle of minimum data necessary,and protect personal data for the purpose of protecting national public health security and protecting the privacy of citizens.
