国际贸易惯例法律属性探析

摘　　要：在国际贸易实践活动中,国际贸易惯例被广泛应用,以规范贸易当事人行为活动,避免或减少争议纠纷,保障了国际贸易活动的有序开展。对国际贸易惯例的准确理解与合理运用具有重要的法律与实践意义,是从事国际贸易经营活动的人员必须熟知的内容。因此,应重视对国际贸易惯例的分析研究,明确其法律属性问题。文章以国际惯例要义为基础,对其法律属性以及在合同中的适用方式展开重点探讨,并对国际贸易惯例条文新的发展趋势进行了分析。In the practice of international trade,international trade practices are widely used to regulate the activities of trade parties,avoid or reduce disputes,and ensure the orderly development of international trade activities.Accurate understanding and rational use of international trade practices are of great legal and practical significance and must be familiar to those engaged in international trade activities.Therefore,we should pay attention to the analysis and study of international trade practices and clarify their legal attributes.Based on the essence of international practice,this paper focuses on its legal attributes,analyzes the ways of application of practice in contracts,and analyzes the new development trend of international trade practice provisions.
