摘 要:学界对不动产物权登记行为性质有“行政行为说”“行政事实说”“公法行为说”“私法行为说”以及“混合行为说”等不同观点。根据不动产物权登记行为的构成要素、内在功能、法律效果可知,不动产物权登记应当具有公法属性,是一种行政法律行为,登记错误时应当按照行为违法为主、结果违法为辅的原则承担国家赔偿责任。The academic world has different views on the nature of real right registration of real estate,such as“administrative act”,“administrative fact”,“public law act”,“private law act”and“mixed act”.According to the constituent elements,internal functions and legal effects of the real right registration,the real right registration of the real estate should have the property of public law and be a kind of administrative legal act.In case of registration error,the state compensation liability should be assumed in accordance with the principle that the act is illegal and the result is illegal.
