浅析保险欺诈和保险诈骗

摘　　要：在实践中,保险欺诈常常被定性为民事不法的欺诈行为,导致保险行业理赔风险管控面临严峻挑战。本文以最常见的车辆保险欺诈为例,通过分析保险欺诈和保险诈骗的客观特征、主观目的以及损害程度,比较域外保险反诈骗的司法实践,提出保险金诈骗类欺诈行为实质上应当界定为保险诈骗行为。In practice,insurance fraud is often characterized as a civil wrongful fraud,resulting in serious challenges to claims risk management in the insurance industry.This article takes the most common vehicle insurance fraud as an example,analyzes the objective characteristics,subjective purpose and damage degree of insurance civil fraud and insurance criminal fraud,compares the international judicial practice of insurance fraud prevention,and proposes that insurance fraud should be defined as insurance criminal fraud in essence.
