摘 要:“二选一”行为是具备竞争性质的交易行为,不能简单等同于滥用市场支配地位、不正当竞争或滥用相对优势地位的行为。“二选一”行为是否能够适用竞争法的相关规定,需要考量行为主体、行为表现、行为目的和损害后果四个因素。损害后果是考量的关键,应当从市场公平竞争秩序、其他经营者利益、消费者权益以及激发科技创新四个方面综合评判。要使“二选一”乱象得到有效治理,应当充分发挥民事司法裁判的个案指导功能,寻找政府规制和平台自治的平衡点,尝试开启消费公益诉讼,加强信用治理和社会共治。The“one out of two”behavior is a competitive transaction behavior,which can not be simply equated with the abuse of market dominance,unfair competition or abuse of comparative advantage.Whether the“one out of two”act can be applied to the relevant provisions of the competition law,requires consideration of four factors:the subject of the act,the performance of the act,the purpose of the act and the consequences of the damage.The damage consequence is the key to be considered.It should be comprehensively judged from four aspects:the order of fair market competition,the interests of other operators,the rights and interests of consumers,and the stimulation of technological innovation.In order to effectively manage the chaos of“one out of two”,we should give full play to the case guidance function of civil judicial judgment,find the balance point between government regulation and platform autonomy,try to open consumer public interest litigation,strengthen credit governance and social co-governance.
