摘　　要：《中华人民共和国香港特别行政区维护国家安全法》赋予驻香港特别行政区维护国家安全公署对重大危害国家安全犯罪案件的例外管辖权,是国家管辖权在香港特区的延伸和具体适用。特区高度自治权属于国家治理权,与国家管辖权共同在香港实践中实现全面管治权。根据国家主权理论,在“一国两制”框架下构建国家权力模型,将国家权力类型化为人民主权、宪法性权力与法律性权力。2019年香港经济实证研究反映出修例风波对香港经济的严重破坏,以及对人民利益的损害。例外管辖权通过维护人民利益巩固国家权力基础。The Law of the People’s Republic of China on Safeguarding National Security in the Hong Kong Special Administrative Region gives the office for Safeguarding National Security of the Central People’s Government in the Hong Kong Special Administrative Region the exceptional jurisdiction over serious crimes endangering national security.It is an extension and specific application of national jurisdiction in the Hong Kong.The high degree of autonomy of Hong Kong belongs to the power of national governance,and it works with national jurisdiction to realize the overall governance in Hong Kong.According to the theory of national sovereignty,a model of the national power is constructed under the framework of“one country,two systems”,and national power is classified into the people sovereignty,constitutional power and legal power.The analysis of Hong Kong’s economic indicators in 2019 reflects the serious damage to Hong Kong’s economy and the people’s rights caused by the Hong Kong’s Extradition Law Protest.Exceptional jurisdiction strengthens the foundation of national power by safeguarding the rights of the people.
