摘　　要：本文通过对新修订《档案法》“法律责任”章的分析,发现其规范内容主要属于处罚性规定,还可能适用于本章没有明文规定的行为类型。第四十八条的构成要件要素主要包括执法主体、违法主体、处分对象等。第四十九条与第四十八条在适用上还会产生竞合的问题。Through the analysis of the chapter'Legal liability'in the newly revised Archives Law,this paper finds that its normative content mainly belongs to the punitive provisions,and may also be applicable to the types of behaviors that are not explicitly stipulated in this chapter.The elements of Article 48 mainly include the subject of law enforcement,the subject of violation of law,the object of punishment,etc.The application of Article 49 and Article 48 will also produce the problem of concurrence.
